Public Calendar Acceptable Use Policy

Public Calendar Acceptable Use Policy (hereinafter referred to as these “AUP”) shall govern the service made available by TimeTree Inc. (hereinafter referred to as the “Company”) to users (hereinafter referred to as “Users”) by which they can release to third parties (including other users; the same shall apply hereinafter) calendars that they have editing authorities (said service shall be hereinafter referred to as the “Public Calendar Service”). These AUP stipulate conditions for providing the Public Calendar Service and matters related to rights and obligations between the Company and Users. Users are required to agree to these AUP in utilizing the Public Calendar Service.

Article 1. Application of AUP

  1. In addition to these AUP, TimeTree AUP stipulated by the Company (https://timetreeapp.com/intl/en/terms/service) shall apply to Users creating Public Calendars in connection with the Public Calendar Service. Furthermore, the Public Calendar Service shall be included in the “Services” in the TimeTree AUP.
  2. Any matter not stipulated in these AUP shall be governed by the TimeTree AUP. If there is any conflict or inconsistency between these AUP and the TimeTree AUP, the applicable provision in these AUP shall prevail over the applicable provision in the TimeTree AUP.
  3. Users must use the Public Calendar Service in accordance with these AUP and the TimeTree AUP. Users also are responsible for complying with all applicable laws and regulations when using the Public Calendar Service.

Article 2. Application for use

Users, regardless of whether they are individuals or corporations, shall apply for use of the Public Calendar Service in a manner designated by the Company after agreeing to these AUP.

Article 3. Overview of the Services

  1. The abilities of the Public Calendar Service offered by the Company shall be as follows. Furthermore, the details shall be separately specified in the Company website.
    1. Ability that allows Users to create Public Calendars
    2. Ability that allows Users to invite third parties to the Public Calendar
    3. Ability that allows Users to edit the Public Calendar
    4. Ability that allows Users to add detailed information such as images, scheduled dates and times, and URLs to the Public Calendar
    5. Ability that allows the Company to share Public Calendars with third parties
    6. Ability to generate URLs for Public Calendars and calendar images
    7. Ability that allows Users to view Public Calendars created by other Users
    8. Ability that allows Users to view Public Calendars created by other users in their own calendars
    9. Ability to make announcement from the Company and notify of the contents, etc. posted by Users
    10. Ability to allows Users to view various indicators such as the number of followers and views of the Public Calendars
    11. Ability that allows the Company to present or announce (hereinafter collectively referred to as making “Recommendations”) Public Calendars to other users, according to the Company criteria
    12. Other abilities specified by the Company
  2. The Company may use the contents of Public Calendars (including, but not limited to, images, scheduled dates and times, and URLs) in Recommendations.
  3. The Company does not guarantee the number of Recommendations to be made or that the number of views will be increased.
  4. The Company shall be entitled to change the abilities of the Public Calendar Service from time to time at its own discretion without consent of Users. The Company shall not be liable for any disadvantage or damage incurred by Users due to such change in or of the contents of the Public Calendar Service.

Article 4. Attribution of rights in and to Public Calendar Service

  1. The copyright of the works used by a User in the Public Calendar Service (including, but not limited to, images and logos) (hereinafter referred to as the “Works”) shall be reserved by the User. However, the User shall grant the Company a license free of charge to use the copyright of such Works to the extent necessary for the Company to provide the Public Calendar Service (including, but not limited to, the right of reproduction, the right of published transmission, and the right of adaptation). The Company shall not be liable for any complaints or troubles arising from Recommendations on the Public Calendars, unless there is a willful act or gross negligence on the part of the Company.
  2. All the rights in and to the images produced under Item 6, Paragraph 1 of the preceding Article (hereinafter collectively referred to as the “Generated Images”) shall belong to the Company.
  3. The User represents and warrants to the Company that he/she has the lawful right to post the Works and that the Works do not infringe the rights of any third parties. Should the Works be found to infringe the rights of third parties, the User shall remove such Works and compensate or make up for damages incurred by the Company.

Article 5. Period of use and cancellation of Public Calendar Service

  1. The User may use the Services from the date on which the Company consents to such use until he/she ceases to use the Services.
  2. The cessation of use shall be completed by the User deleting the Public Calendar created by him/her. At the time of said deletion, however, the Company shall not be responsible for deleting any log related to users' Public Calendar remained posted on any website other than the Public Calendar Service, .

Article 6. Suspension of use and cancellation of registration

If the Company deems that it is not appropriate for a User to continue to use Public Calendar Service (due to violation of these AUP by him/her or any other reasons), it may suspend the use by him/her or deregister him/her without prior notice or demand.

Article 7. Account

  1. Users shall be responsible for strictly controlling the passwords for their accounts to use their Public Calendars (herein after referred to their “Accounts”) in order to prevent any unauthorized use.
  2. If any operation is performed using the registered User's password, the Company shall deem it as the User's act and provides the Services to him/her.
  3. The Company may, if desired by the User, assist him/her in operating the Public Calendar to a reasonable extent. In this case, he/she shall grant the Company the authority necessary to operate the Public Calendar to the extent necessary for it assist him/her. Then, the Company may access and operate his/her Public Calendar within said extent.
  4. Users may engage the Company or a third party designated by the Company to operate their Public Calendars. In this case, the User shall grant the Company or a third party designated by the Company the authority necessary to operate the Public Calendar in advance.

Article 8. Amendment to these AUP

  1. The Company may, if necessary, amend these AUP and the details of the Public Calendar Service by way of publication or notice to Users in accordance with the laws and regulations.
  2. In case of the preceding Paragraph, the Company shall inform Users of the contents and effective date of the amended AUP by displaying them on the Public Calendar Service or on the Company Website, and the amended AUP shall become effective on the effective date.

Article 9. Obligation to notify

If the User has changed his/her/its trade name, name, email address, address or other contact information, he/she/it shall immediately notify the Company of the change in the manner prescribed by the Company.

Article 10. Governing law and court of jurisdiction

These AUP shall be governed by the laws of Japan. Any dispute arising in connection with these AUP shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
